{"id":540,"date":"2020-10-22T18:09:03","date_gmt":"2020-10-22T15:09:03","guid":{"rendered":"https:\/\/scale.co.ke\/blog\/?p=540"},"modified":"2021-11-01T14:58:25","modified_gmt":"2021-11-01T11:58:25","slug":"design-competition-as-a-procurement-method","status":"publish","type":"post","link":"https:\/\/scale.co.ke\/blog\/design-competition-as-a-procurement-method\/","title":{"rendered":"Design Competition as a Procurement Method"},"content":{"rendered":"<p>A Design Competition is defined as a \u2018means a procurement procedure for obtaining competitive tenders for services which are creative in nature and which require that part of the services be carried as part of the tender to facilitate evaluation of the tenders and such services may include architecture, landscaping, engineering, urban design projects, urban and regional planning, fine arts, interior design, marketing, advertising and graphic designs\u2019.<\/p>\n<p>Simply put, design competitions are mainly used as a procurement method for the purpose of determining the best architectural, physical planning, engineering, graphic or any other design scheme for its use.<\/p>\n<p>Here are examples design competition advertisements from the <a href=\"http:\/\/www.innovationagency.go.ke\/\" target=\"_blank\" rel=\"noopener noreferrer\">Kenya National Innovation Agency (KENIA)<\/a> and from the <a href=\"https:\/\/www.epra.go.ke\/\" target=\"_blank\" rel=\"noopener noreferrer\">Energy &amp; Petroleum Regulatory Authority<\/a> that ran in 2016 and 2019 respectively:<\/p>\n<p><img loading=\"lazy\" class=\"aligncenter wp-image-935 size-full\" src=\"https:\/\/scale.co.ke\/blog\/wp-content\/uploads\/2020\/10\/design-competitions-1.png\" alt=\"\" width=\"1131\" height=\"1025\" srcset=\"https:\/\/scale.co.ke\/blog\/wp-content\/uploads\/2020\/10\/design-competitions-1.png 1131w, https:\/\/scale.co.ke\/blog\/wp-content\/uploads\/2020\/10\/design-competitions-1-300x272.png 300w, https:\/\/scale.co.ke\/blog\/wp-content\/uploads\/2020\/10\/design-competitions-1-1024x928.png 1024w, https:\/\/scale.co.ke\/blog\/wp-content\/uploads\/2020\/10\/design-competitions-1-768x696.png 768w\" sizes=\"(max-width: 1131px) 100vw, 1131px\" \/><\/p>\n<p>Here\u2019s a more recent example of an advertisement for a public competition to design a corporate logo and tagline for the <a href=\"https:\/\/busiacounty.go.ke\/\" target=\"_blank\" rel=\"noopener noreferrer\">County Government of Busia<\/a>:<\/p>\n<p><img loading=\"lazy\" class=\"aligncenter size-full wp-image-936\" src=\"https:\/\/scale.co.ke\/blog\/wp-content\/uploads\/2020\/10\/design-competitions-2.png\" alt=\"\" width=\"651\" height=\"795\" srcset=\"https:\/\/scale.co.ke\/blog\/wp-content\/uploads\/2020\/10\/design-competitions-2.png 651w, https:\/\/scale.co.ke\/blog\/wp-content\/uploads\/2020\/10\/design-competitions-2-246x300.png 246w\" sizes=\"(max-width: 651px) 100vw, 651px\" \/><\/p>\n<p>In this method of procurement, it is important to note that you will find part of the services are already a part of the tender. This is because the overall shape and the details of the contract are offered by the contractual partner (basically through the creation of a proposed concept design) and not by the procuring entity .<\/p>\n<p>Further, the designers of the best three assessed design schemes usually receive an honorarium and are legally obliged to transfer all intellectual property rights applicable to the design to the procuring entity running the competition.<\/p>\n<h4>Here\u2019s what the Procurement Laws say about Design Competition<\/h4>\n<p>The Design Competition procurement method is governed by Section 100-101 of the <a href=\"https:\/\/scale.co.ke\/blog\/wp-content\/uploads\/2020\/08\/PPADARevisedEdition-2016.pdf\" target=\"_blank\" rel=\"noopener noreferrer\">Public Procurement and Asset Disposal Act Revised Edition 2016<\/a> as outlined below:<\/p>\n<div style=\"margin: 1em 0; border-left: 2px solid #44AD6D; padding: 1em; background: #f9f9f9;\">\n<ol>\n<li style=\"list-style-type: none;\">\n<ol>\n<li>In design competitions, a procuring entity shall \u2014\n<ol type=\"a\">\n<li>invite design proposals through a public advertisement;<\/li>\n<li>ensure the preparation of an invitation sets out the following\u2014\n<ol type=\"i\">\n<li>the name and address of the procuring entity;<\/li>\n<li>the tender number assigned to the procurement proceedings by the procuring entity;<\/li>\n<li>description of technical and functional needs;<\/li>\n<li>an explanation of where and when tenders shall be submitted and where and when the tenders will be opened;<\/li>\n<li>a statement that those submitting tenders or their representatives may attend the opening of the design proposals;<\/li>\n<li>a statement that a copyright or other intellectual property of the top three shall vest in the State.<\/li>\n<\/ol>\n<\/li>\n<\/ol>\n<\/li>\n<li>The evaluation of design proposals shall be undertaken by an evaluation committee established under the Act.<\/li>\n<li>The design process shall be as prescribed in the The Public Procurement And Asset Disposal Regulations, 2020.<\/li>\n<li>Prior to publishing an invitation notice, an accounting officer of a procuring entity shall prepare tender documents and appoint as part of an ad hoc evaluation committee instituted pursuant to the Act at least one independent lay assessor, and technical assessors recommended by the professional regulatory body governing the design competition.<\/li>\n<li>The best three assessed design schemes shall receive as a prize an honorarium as provided for in the internal policies of the procuring entity subject to the guidelines set out in the applicable county or national level or the Regulations to the Act.<\/li>\n<li>In participating in design competitions, all bidders shall undertake to transfer all copyrights, intellectual property rights and patents relating to their designs to the procuring entity.<\/li>\n<li>Upon completion of the design competition, all the submitted design schemes shall become property of the procuring entity. (shall only apply to the best three assessed design schemes provided for in section 101 (5) of the Act.).<\/li>\n<\/ol>\n<\/li>\n<\/ol>\n<\/div>\n<p>The 2020 <a href=\"https:\/\/scale.co.ke\/blog\/wp-content\/uploads\/2020\/08\/THE-PUBLIC-PROCUREMENT-AND-ASSET-DISPOSAL-REGULATIONS-2020.pdf\" target=\"_blank\" rel=\"noopener noreferrer\">Regulations<\/a> go a step further to provide a step by step guide that should be followed by any public procuring entity considering the use of this procurement method as follows:<\/p>\n<div style=\"margin: 1em 0; border-left: 2px solid #44AD6D; padding: 1em; background: #f9f9f9;\">\n<p>88.
